Proposition 134: Male and Female Participation in School and Collegiate Sports

What It Would Do

Proposition 134 would require every K-12 and collegiate school-sponsored or athletic-association-sponsored team or sport — public and private — to be designated as male, female, or coeducational, based on biological sex rather than gender identity. Students would have to compete on the team matching their designated sex, or on a coed team; a narrow exception would let a female student join a male team if no female team exists in that sport. It would bar any government entity or athletic association from penalizing a school for keeping female-only teams, and it gives Colorado's Commissioner of Education authority to enforce the measure for K-12 school districts.

Fiscal Impact

Per the state's official Blue Book analysis, the fiscal impact is indeterminate: it could mean increased workload and legal costs for the Colorado Department of Education if a school district doesn't comply, and minimal cost increases for schools and districts to adopt new policies. Costs for colleges and universities are assumed to come from institutional tuition and fee revenue, not general state funds.

Why We're Voting No

Boulder Progressives opposes Proposition 134 because it would write discrimination against transgender student-athletes into state law, excluding kids from school sports and the community those teams provide.
